Bars and cafès, restaurants and pizzerias (english)

Public businesses such as bars, restaurants, pizzerie are equipped places supposed to consume food and beverage on the spot or possibly on the adjacent area.

Opening of a new business

The prior presentation of the Scia unica (certified report of start-up) to the municipality’s Suap becomes mandatory in order to open a new public business, in accordance with the article 19 of the no.241 August 7th 1990 law.
The activity’s taking up and pursuit require compliance with urban, building, hygienic-sanitary, noise impact, safety and supervision rules established by the current regulation.

Annexes

  • Noise impact report signed by an expert technician, related to the measures adopted to avoid noise pollution. In the following cases, a simple declaration of law observance in accordance with the current regulation (Presidential Decree 227/2011) is admitted: when the restaurant/bar does not employ sound diffusion devices which means that there are not events concerning music diffusion or musical instruments use; when the restaurant/bar does not overcome the noise limits established by the municipal plan of acoustic classification; otherwise SCIA is influenced;
  • a photocopy of the subscriber identity card and the valid residency permit (if non-EU citizen);
  • a proxy to the professional/office or to other bodies in charge of the dispatch and/or following check of the practice;
  • an updated planimetry including the furniture layout in 1:100 scale, dated and signed by the expert technician along with the SCIA dispatch;
  • a self- certification of the moral and professional requirements of the potential employee and his working relationship with the company;
  • an identity card and a valid residency permit of the potential employee;
  • a self- certification of the non-subscriber administrators’ moral requirements together with their identity cards and possible residency permits;
  • professional requirements established by the law in order to sell food and beverage;
  • the receipt of secretarial fee payment to the municipal administrative office. Link

Amendments on existing activities

It is mandatory to exhibit a SCIA unica in order to communicate the replacement, the seat relocation, the changes ( about company, assigned areas, employee, etc.) and the operational management of department.

Other activities

In businesses where food and beverage distribution’s activity is secondary to the entertainment and relaxation ones (discos, games halls, night clubs, beach resorts and similar activities) the SCIA has to be exhibited when the application for permission is made.

Scia Unica has to be exhibited in order to access to food and beverage sale’s activity in the following cases:

  • at consumer’s domicile (with or without cooking areas);
  • in activities placed within the motorways and railway stations’ rest areas (in case of use of sound diffusion devices or exceeding noise limits established by the municipal acoustic zoning plan during temporary events, SCIA is influenced);
  • in public means of transport;
  • in schools, hospitals, religious communities, military establishments and the ones of police forces and the national fire brigades. (in case of use of sound diffusion devices or exceeding noise limits established by the municipal acoustic zoning plan during temporary events, SCIA is influenced).

All the practices have to be exhibited to the Municipality’s SUAP by telematic tools, through the platform www.impresainungiorno.gov.it. Practices in paper copy are no longer accepted.

SCIA’s photocopy and its delivery receipt have to be exhibited in visible places and in case of law enforcement’s require.
Lacking the requirements and law conditions, by 60 days from the practice delivery, Suap will forbid the continuation of the activity seeking for a solution to the problems. In case of false attestations, the activity is suspended.
If it is possible to conform the activity and its effects with the current regulations, the administrator agrees with the start of the activity, requiring all the necessary measures and fixing a deadline no less than 30 days. Once the period has expired, in case of private inactivity, the activity is forbidden.
